"I am selling my client a half duplex (strata titled). There is no strata council so do I use the strata form?"

Yes, you must use our standard contract of purchase and sale for strata properties. When there are only two owners in a strata property they are the strata council. The Standard Bylaws of all strata corporations are established in the Strata Property Act. Those bylaws can be downloaded at http://www.fic.gov.bc.ca/pdf/responsibilities_strata/stdbylaws.pdf.

You will note that under Division 3, Section 9 (2) it says for strata properties of four or less units, the strata council is all the owners. Therefore in a duplex the strata council are both owners.

Division 2 lays out the responsibilities of that strata council to act on behalf of the building.

If they have not passed any further bylaws these stand as the bylaws for the duplex.
